These Terms and Conditions apply to purchases made through benleito.studio.
2. Products
Ben Leito Studio creates and sells design objects, including objects made using handmade and small-scale production processes.
We make every reasonable effort to describe and display our products accurately. However, colours may appear differently depending on your screen and device.
Because of the materials and production processes used, products may show subtle variations in colour, texture, surface, dimensions and finish. These characteristics make each object unique and are not necessarily considered defects. Relevant characteristics and variations will be described and shown as clearly as reasonably possible on the product page.
The product description, images, price and other information shown on the product page form part of the offer.
3. Orders and formation of the agreement
By placing an order, you make an offer to purchase the selected product under these Terms and Conditions.
After placing your order, you will receive an automatic confirmation by email. The purchase agreement is concluded when we accept your order and send you an order confirmation.
We may refuse or cancel an order when:
- the product is unavailable;
- the payment cannot be processed;
- the information provided is incomplete or incorrect;
- we reasonably suspect fraud or misuse;
- an obvious error has been made in the price or product information.
If we cancel an order after payment has been received, the amount paid will be refunded through the original payment method.
4. Prices and payment
All prices are displayed in euros and include VAT where applicable, unless explicitly stated otherwise.
Shipping costs and any other applicable charges will be shown before you complete your order.
Payment is processed through the payment methods offered during checkout. You are responsible for providing complete and accurate billing, shipping and contact information.
Discount codes are subject to the conditions communicated with the relevant promotion. Unless stated otherwise, discount codes cannot be combined, exchanged for cash or applied after an order has been placed.
5. Delivery
Orders are delivered to the address provided during checkout. You are responsible for checking that this address is complete and correct.
Estimated preparation and delivery times are shown on the website or communicated during the ordering process. Unless another delivery period has been agreed, we will deliver the order without undue delay and no later than 30 days after the agreement was concluded.
If delivery is delayed, please contact us. Your statutory rights regarding late or failed delivery remain unaffected.
The risk of loss of or damage to the product remains with benleito.studio until you, or a third party designated by you other than the carrier, have received the product.
6. Right of withdrawal and returns
Consumers may have a statutory right to withdraw from an online purchase within 14 days after receiving the product.
The conditions, instructions, exceptions and information about return shipping and refunds are set out in our Returns & Refunds Policy, which forms part of these Terms and Conditions.
Nothing in these Terms limits your statutory right of withdrawal or your statutory rights if a product is faulty, damaged or not as described.
7. Faulty, damaged or non-conforming products
You are entitled to receive a product that conforms to the agreement and has the qualities you may reasonably expect based on the product description and other information provided before purchase.
If a product is faulty, damaged or not as described, please contact us as soon as reasonably possible at hello@benleito.studio. Include your order number, a description of the issue and, where possible, photographs of the product and packaging.
We will assess the issue and provide an appropriate solution in accordance with applicable consumer law. This may include repair, replacement, a price reduction or a refund.
Handmade characteristics that were clearly described or shown before purchase are not necessarily defects.
8. Customer accounts
You may be able to create or use a customer account through Shopify or Shop.
You are responsible for providing accurate information and keeping your login details secure. Please contact us promptly if you believe your account has been used without your permission.
We may suspend or restrict an account where reasonably necessary to prevent fraud, misuse, unlawful activity or security risks.
The processing of personal information connected to customer accounts is described in our Privacy Policy.
9. Reviews and other content
Where product reviews are available, you are responsible for the content you submit.
Reviews must not contain unlawful, misleading, abusive or discriminatory content; infringe another person’s rights; contain personal information about others; or contain malicious software or spam.
We may refuse or remove content that violates these conditions or applicable law.
By submitting a review, you grant benleito.studio a non-exclusive, royalty-free licence to display and reproduce that review in connection with our store and products. You retain ownership of your original content.
10. Intellectual property
All content on this website, including product designs, photographs, illustrations, text, graphics, logos and other materials, is owned by or licensed to benleito.studio and is protected by applicable intellectual property laws.
You may use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify, commercially exploit or otherwise use protected content without prior written permission, except where permitted by law.
11. Website availability and third-party services
We aim to keep the website accurate, secure and available, but we cannot guarantee that access will always be uninterrupted or error-free.
The website may contain links to or use services provided by third parties, including Shopify and payment providers. Those third parties may apply their own terms and privacy notices.
Nothing in this section excludes responsibilities or rights that cannot legally be excluded.
12. Liability
Benleito.studio is responsible for loss or damage that is a foreseeable result of our failure to comply with the agreement or applicable law.
We are not responsible for loss or damage caused by circumstances outside our reasonable control, incorrect information supplied by the customer, or use of a product contrary to its intended purpose or provided instructions.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, or your statutory consumer rights.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms and Conditions when our business, services or applicable laws change.
The version in effect when you placed your order will continue to apply to that order. Changes will not apply retroactively to purchases already concluded.
15. Governing law and disputes
These Terms and Conditions and any purchase agreement with Ben Leito Studio are governed by Dutch law.
If you live in another country within the European Union, this choice of law does not deprive you of any mandatory consumer protection provided by the law of your country of residence.

Any dispute may be submitted to a competent court in accordance with applicable law.
